The Process of Divorce Mediation


 

While most divorces can be solved outside of the court, and in fact most are, there are still some where some sort of divorce mediation may be needed. There are several things to consider in a mediation and one of them is children.

Should there be any children between the oule, mediation is necessary to make sure that the child’s best interests are taken care of and that the child’s wishes are respected if they are of age. Houses and investments are also going to be major parts of mediation if they are a part of the home estate.

What’s the major process of all this though? The first issue is that there has to be a disagreement between the two parties that can’t be figured out outside of court. After this, the court can order or the individuals can request divorce mediation in order to ensure all parties are taken care of and appropriately represented.

Overall, the process is much simpler than you’d think. Attorneys from both parties convene, choose the mediator, and then agree to the matters that the divorcing couple want to cover. Once things are decided, then mediation can begin. This can take some time depending on the amount of disagreement and the amount of assets that both parties have.
